Crew Terms & Conditions
These Terms and Conditions constitute a binding agreement between Gariful Yacht Charter (“Charter Company”) and the Client (referred to as “Charterer”) who rents a vessel with a professional skipper.
By confirming the booking, the Charterer agrees to the conditions stated below:
1. CHARTER SERVICE DESCRIPTION
The rental includes:
· A fully equipped vessel in accordance with the booking specifications
· Licensed, experienced skipper provided by Gariful Yacht Charter
· Safety equipment and standard onboard amenities
· Basic passenger insurance under Croatian maritime law
Not included unless otherwise specified:
· Fuel (charged according to actual consumption)
· Port fees, mooring charges, food & beverages, and tickets to attractions
· Additional crew (hostess, guide, etc.)
2. PAYMENT TERMS
· A booking is confirmed upon receipt of an advance payment (50% of the total charter fee).
· The balance is due prior to departure, either via bank transfer, card (charged in euro), or cash (per agreement)
· Full payment is required immediately for bookings made less than 10 days before departure.
· A valid proof of identity (passport or ID) must be presented prior to embarkation.
3.CREDIT CARD PAYMENT SECURITY, CONVERSION STATEMENT AND PROTECTION OF INFORMATIONS
· Client can make a payment for online reservation with credit and / or debit cards: MasterCard ®,
Maestro ®, Visa ®, V Pay®, Diners ®.
· Client’s card is charged immediately by Gariful Charter Company upon transaction.
· Credit card charge is done in Euro (€).
4. SKIPPER’S RESPONSIBILITIES AND AUTHORITY
· The skipper is solely responsible for operating the vessel and ensuring navigational safety.
· The Charterer and guests are not permitted to steer, anchor, or handle technical equipment without the skipper’s explicit
permission.
· The skipper has full discretion to modify the itinerary due to weather conditions, sea state, or safety considerations.
· All guests must comply with the skipper’s safety instructions at all times.
· The Skipper makes real-time decisions based on sea conditions, and the Charterer shall not be held liable for those decisions,
provided they follow the Skipper’s instructions at all times; if the Charterer acts against such instructions, they may be fully or
partially responsible for any resulting damage or consequences.
5. CHARTERER’S CONDUCT AND RESPONSIBILITY
· The Charterer bears responsibility for the behavior of all passengers on board.
· Any damage, loss of equipment, or violation of local regulations caused by the Charterer or their party will be charged
accordingly.
· Reckless behavior, excessive alcohol consumption, or disrespect of maritime rules may result in immediate termination of the
trip without refund.
6. SECURITY DEPOSIT (unless otherwise specified)
· A refundable security deposit may be required prior to embarkation, depending on the vessel category.
· The deposit is returned in full after disembarkation, provided no damage, loss, or breach of terms occurred.
· In case of damage caused by negligence or misconduct, repair costs will be deducted from the deposit.
· In serious cases, Gariful Yacht Charter reserves the right to seek additional compensation.
7. CANCELLATION POLICY
By the Charterer:
· More than 30 days before departure: 100% refund
· 30–15 days before: 50% refund
· 14–3 days before: no refund
· 2 days or less: no refund
By Gariful Yacht Charter:
In the event of force majeure, technical failure, or severe weather, Gariful Yacht Charter will offer:
· an alternative departure date,
· a different vessel (same or higher class), or
· a full refund if no alternative can be arranged.
· Gariful Yacht Charter is not liable for cancellations or delays caused by external factors beyond its control.
8.ROUTE AND WEATHER FORECAST
· All routes and excursion points (e.g. Blue Cave, Hvar, Vis) are subject to change depending on sea conditions and port
regulations.
· If a destination is unavailable due to weather, safety, or official closure, no partial refunds will be given.
· The skipper reserves the right to cancel swimming or diving activities based on safety judgment.
9. INSURANCE & SAFETY
· The vessel and all passengers are covered by third-party liability insurance as required by Croatian law.
· The Charterer is advised to obtain additional personal travel insurance if desired.
· All passengers must behave in accordance with maritime safety rules.
· Children must be supervised at all times.
· Wearing life jackets may be required depending on conditions.
10. COMPLAINTS & DISPUTES
· All complaints must be submitted in writing during the charter period, directly to Gariful Yacht Charter or the skipper.
· Later complaints may not be considered unless exceptional circumstances are proven.
· In case of disputes that cannot be resolved amicably, jurisdiction lies with the competent court in Split, Croatia.

1.Security Deposit
• A security deposit is required at check-in (payable in cash or by credit card).
• The deposit is fully refundable if the yacht and equipment are returned undamaged.
• In case of damage or missing equipment, part or all of the deposit may be retained.
• If damage prevents the yacht from being re-chartered, a loss of income may be deducted.
2.Cleaning & Fuel
Final Cleaning Fee:
• Mandatory:Fuel Policy: All yachts must be returned with a full fuel tank.
• Mandatory:Transit Log (final cleaning,clean bed linen and towels)
3.Check-In / Check-Out
• Check-In: As agreed in your charter contract.
• Return Time: The yacht must be back in the marina the night before check-out, unless otherwise arranged.
• On handover, the yacht and equipment are inspected.
• Bad weather is not accepted as a valid reason for late return.
4.Yacht Delivery by Charter Company
We deliver:
• A clean, dry, and fully fueled yacht, ready to sail.
• All equipment checked and inventoried.
5.Charterer Responsibilities
• After taking over the yacht, the Charterer is responsible for:
• All operational costs: fuel, berths, water, cleaning, etc.
• Daily maintenance: checking engine oil, sail care, and keeping a logbook.
• Sailing only within Croatian territorial waters.
• Safe navigation in good weather and visibility conditions.
6.The Charterer must:
• Possess a valid nautical license and radiophone certificate.
• Not operate the yacht under the influence of alcohol or illegal substances.
• Not sail without a valid license.
• Not sub-charter or use the yacht for commercial purposes.
• Not sail at night or participate in races without prior agreement.
• Not exceed the number of guests listed on the crew list.
• Not bring pets on board
7.Accidents & Damage
• All damages, losses, or incidents must be reported to Charter Gariful immediately.
• In case of serious issues (e.g., confiscation, seizure, inability to navigate), both authorities and the charter company must be informed without delay.
• The Charterer is financially and legally responsible for any violations, penalties, or damage caused during the charter.
